The current law governing the process of a person filing bankruptcy is The Bankruptcy Abuse and Consumer Protection Act (BAPCA). The Act went into effect in October of 2005. The United States Trustee Program is the component of the U.S Department of Justice that administrates and enforces the bankruptcy laws. The Trustee Program oversees the agencies that are approved to offer the different counseling and education sessions to those people seeking protection from their creditors through bankruptcy. Consumer Credit Counseling of Southern Oregon is approved by the U.S. Trustees Program to provide the services and issue certificates in compliance with the Bankruptcy Code.*
The Act requires that people seeking protection from their creditors through bankruptcy attend a Pre-Filing Counseling session prior to filing for bankruptcy. The bankruptcy process is discussed and all options are explained to the client during the session. Upon completion of the counseling session, a Pre-Filing Certificate of Counseling will be issued to be used to file for bankruptcy.
The Act also requires that before the debt can be discharged, persons going through bankruptcy must attend a Pre-Discharge Education Class. In the class, students are given tools to help them develop a budget and rebuild their credit after their bankruptcy discharge. Upon completion of the education class, a Pre-Discharge Certificate of Education is issued for attending the class.
